Panel title: '''Harnessing the Generative Internet for the Public Good'''

The generativity of the internet is its greatest strength, and also its greatest weakness. How can we harness the collective power of generativity to combat the uglier side of what openness brings to the net? StopBadware aims to use community action to fight badware. How have other groups used, are currently using, and could potentially use the Internet's generativity to help protect users from malware and related issues?

[Note to fellow Berkmaniacs: We'd be interested in collaborating with folks working on broader online safety issues too (Digital Natives folks & child protection? Diane R and domestic violence via spyware? etc.). We're kinda thinking fighting the dark side of the Force with light-side Jedis, here.]

Coordinated by: StopBadware team (esp. Max & Erica)

Idea: Leading up to the conference, hold a video contest for people to submit short videos showing their vision of future success (good side of Internet triumphs over evil) or failure (vice versa). Use the winners of the contest as a starting point for discussion.

Potential panelists (this is brainstorm, no invites or confirmations yet):
* JZ as moderator
* Paul Laudanski from CastleCops
* Vandana from Herdict

Questions for discussion:
* What is already being done to use mass collaboration against badware?
* What can we learn from other issues and groups using crowdsourcing or technical means to harness the Internet's power?
* How active does the distributed involvement need to be? Can we counter bad botnets with distributed "botnets" of our own?

How can video games -- which rely so heavily on giving users meaningful choices -- promote pro-values such as responsibility, charity, or sacrifice? Can video marry these values to the kind of "systems thinking" at which they're particularly good and which are becoming more vital in our networked world? WGBH, the renowned public television station, is launching a transmedia TV show and game that tackles these questions head-on. In this workshop, you'll help have a chance to shape this project that aims to teach children about environmental systems and their own choices within that system.

'''What you'll brainstorm in this workshop'''

WGBH is proposing a transmedia TV show set within a game as well as video games to give children ages 9-12 an understanding of the environment as a complex system and their ability as individuals and engaged members of society to affect that system. Ultimately, the goal of the program is not just to advance scientific understanding, but also deepen participants' concern for the Earth.

In this workshop, we will have the chance to develop game concepts related to one unit of the underlying curriculum.

'''What you'll do in this workshop'''

After project leads from WGBH present the basic goals of the show, we will be breaking up into small teams to brainstorm game designs that will advance the presented goals. We'll reconvene to hear these ideas and give each other feedback. We'll then break up a second time to hash out the ideas further, and present our final suggestions.

Each group will develop gameplay with special attention to a different issue:

* Evaluation: How do we know that players are learning the intended knowledge, skill, or values objectives?
* Affect: How can the design deepen moral, spiritual, personal, or other values-based commitment to environmental protection? (Or, alternatively, raise the question in a meaningful way?)
* Motivation: What are the incentives for youth to play this unit?
* Safety: How does WGBH ensure the safety of the participants while also encouraging maximum engagement and openness?
* Transmedia opportunities: What opportunities arise because the game will run alongside a TV show?
* Engagement: How does the program resolve the apparent tension between a show that encourages engagement with nature and a medium (video games) that's often tied to an indoor computer or console?
* Participation gaps: How can the game ensure that significant gaps do not open up across genders, class, rural/urban, or other social divisions?
* Business model: Can this game be financially sustainable? Profitable?

Session goal 1: country profiles from researchers who work in different areas of the world. Presentations will be quick overviews of the internet, technology infrastructure, usage patterns, etc. in disparate regions
Description:
The Global Internet: Emerging Tech in Emerging Markets

The Internet as a technology with specific capabilities is remarkably context-dependent depending on where users are located and what infrastructure they can access. Weather-dependent in Cambodia, subject to invisible and constantly shifting censorship in Uzbekistan or China, or still delivered primarily over dial-up speeds in rural areas around the globe, the objective measure of "Internet access" doesn't tell us that much about what kinds of content people can access, the interaction and communication modes they adopt, and how the technology gets integrated into everyday life and professional practice. In these areas of greater constraint, people are innovative and unpredictable in how they adapt certain technologies to local needs. When we look at specific countries and people's patterns of adoption and usage, how does our understanding of the global Internet change? The innovative use of Internet and mobiles in emerging markets points to what kind of future for other emerging technologies?

Discussion questions:

1. Innovation. What innovative uses or adaptations of technology at the grassroots levels can we see and learn from? Can these grassroots innovations be leveraged by entrepreneurs?

2. Infrastructure. What does infrastructure look like at a detailed level and how does that affect how Internet-related technologies are spreading, how they are being used, and what future growth patterns are likely to be.

3. Policy. What are the characteristics of local regulatory schemes that encourage or discourage the growth of Internet-related industries. Based on the current directions of policy, where might Internet industries/usage/adoption experience the most growth?

Nothing matters more than what the Net *is*. Yet when we call it a "space" or a "stage" or "pipes," we frame it with metaphors that yield very different purposes, laws and business models—also different futures. What different laws and regulation do we get by framing the Net in terms of real estate ("domains," "sites," "commons"), transport ("packets," "content," "pipes") or theater ("audience," "experience")? How do these different frames guide debate over net neutrality, open infrastructure, governance, regulation, public good and business opportunity? Are there other ways of framing the Net, and how might they help?
[http://www.ideico.net ideico]

----

1. Framing the Net: What We Say is What We Get.

If we say the Net is comprised of "sites" at "locations" in "domains" that we "architect," "design," "construct," and "build" for people to "visit", what are we saying the Net *is*?

And when we say the Net is a set of "pipes" over which we "deliver," "move,"pump" and "ship" stuff we call "content" in the form of "packets" using "transport" protocols... what kind of lawmaking and regulation does that invite?

How does that lawmaking and regulation change when we shift from real estate and shipping metaphors to those of publishing, which are what we use when we say the Web is comprised of "pages" and "documents" that we "write," "author," "post" and "syndicate"?

Metaphors give us the vocabularies we use to frame our understanding of everything we know. They're what we think and talk "in terms of" -- for everything, including the Net. They also frame laws, policies, practices and curricula -- with vastly different results, depending on the frames employed. Think about Senator Steven's tortured discourse on trucks and tubes.

All our disagreements about the Net arise from conflicting frames. The carriers opposed to Net Neutrality, for example, frame the Net as a mostly private transport system, much of which they own. Those who favor Net Neutrality frame the Net as a place (or a space), for free expression and association.

In this session we'll source and surface these frames and the differences between them, present them if fun detail, and look at which garden paths each one leads us down -- and thus frame up the discussion that follows.
Subjects on the table: friction of distribution; costs of getting clearance wrong
* For WGBH, a huge problem, limited resources, old records. expectations of distribution vs limited release; archival clearances, cost, burden,
* Vietnam series, 1981, 100 releases in the file. Gerald Ford to South Vietnam; international distribution.
* WGBH: Huge transactional effort, inefficient. New ways to acquire rights such as voluntary blanket licenses going forward might also help with retrospective clearances.
* Viacom: archive going back to 1947 Paramount, also huge clearance issues. Solution is not to wipe out rights, but to use tech to clear better.
** cleared entire motion picture library for DVD, now gone back to online, download once, etc. We want to be everyplace. That's lots of rights to clear, but its fundamentally our business.

* Assn of Commercial Stock Image Licensors. [http://www.acsil.org/news/doc/ACSIL%20Grid%20FAQ.pdf ACSIL Grid]. Look at how people use content rather than how it's delivered. Personal use, home use, rather than tv/phone.

WGBH recent conference. Content owners acknowledge that the system has broken down.

Morril: Working to develop a class of tolerated use, broader than fair use/not conceding the fairness as a matter of law, but permitted.
* we're big supporters of the First Amendment.

* Defining the rights sets. differing definitions among unions, writers, television, photo; among groups within an industry.

* Open educational resources. cautious gatekeepers?
* expanding the scope of non-commercial use limitation of liability

* Terry Fisher: We haven't yet talked about legislative change (and that's good!). Rather, private responses. best practices, licensing changes, unilateral action, fair use assertion.
** should we be aspiring to create, privately, a global copyright registry?
** MM: Streamline the navigation, respecting rights.
** TF: to do it in distributed fashion, need standards for data fields
** EK: no standardized system. We use paper, because systems costing millions of $ don't work

* How does this affect individual creators?

* MM: we consider it a major success if we can keep our movies off the internet through opening weekend; if we can keep John Stewart and Steven Colbert off until their shows are over.
* How do we protect the creator's right to control distribution?

* Will new media breed new copyright practices?
* Is copyright education law or ethics?
The brain metaphor constitutes an attractive system of ideas for studying organizational phenomena. In this paper, it is used the brain metaphor as a point of departure in developing another informational metaphor: the network metaphor. How can work at Berkman and similar .edu entities support positive growth in Net-based markets? Put another way, how can we create a rising tide that lifts all business boats? Did we do that with Creative Commons? How can we do it with ProjectVRM or our media-related projects?

How does an activist center such as Berkman not only fit in the larger ecosystem, but improve it?

How can we better attract interest and investment from large companies willing to invest in rising tides rather than more prosperous boats?

(This general subject is one that Renee and I have been working on.)
It has been argued that new information technologies and other online tools have the capacity to enhance political transparency and the accountability of government officials, processes, and institutions to their citizens.

There are a lot of myths floating through the ether about how young people use new technologies. Does it make sense to talk about a distinctive global culture of young people -- Digital Natives -- who have only known life in a digital age? This session will focus on what research does and doesn't teach us about what this population of young people are up to? What are the great things that we wish to foster, like creativity using digital tools and new forms of civic activism? What are the things that we should be worried about, from safety to information overload? This session will explore recent research at the Berkman Center and elsewhere on the way that some young people use technologies differently -- or the same as -- those who are older.

Some myths that we may explore for the day:

'''Myth #1'''
''The online world presents a wholly new and completely different set of issues for youth we must address.''

Many of the issues cropping up with children and young people playing, being, and living online – from cyberbullying, to information evaluation, to online civic engagement - are the same as age-old offline issues, however filtered through a new medium with new possibilities, and new considerations.

'''Myth #2'''
''Digital Natives are wasting time online.''

Young people are learning, gaining skills, and becoming collaborative, critical and informed members of society through their online and digital engagements.

'''Myth #3'''
''Young people online are hugely susceptible to falling victim to sexual predators.''

Digital natives are very aware of the issue of predators sexual online, and even more aware of how to avoid this danger. In fact, one of our most consistent findings among young people across ages and socio-economic groups was their ability in using a variety of strategies to avoid unwanted contact with strangers online.

'''Myth #4'''
''Digital Natives don’t care about privacy.''

New technological affordances have meant that for most digital natives, sharing via digital tools has become the norm – but this does not mean they don’t care about privacy. Privacy concerns vary largely among young people based on age, education, and if repercussions of privacy compromise have been experienced. “Privacy from whom?” is an important question here – hugely differing attitudes are prevalent in regards to sharing with friends, strangers, service providers, and government entities.

'''Myth # 5'''
''Digital Natives don’t care about copyright.''

Copyright is a complicated and scary word – for most digital natives, a notion just vaguely related to something illegal. Young people are hugely lacking in knowledge regarding issues of legality concerning copyrighted content online. While for sure the norm among young people is access for free, many are not indifferent to the rights of creators.

'''Myth #6'''
''All digital natives are experts at navigating online spaces and tech-savy creators.''

While the vast majority of young Americans have access to technologies, the knowledge of digital tools, online spaces, and skills in this arena widely vary. While socio-economic and access to education are strong factors in determining digital natives’ skill level, so is their social group: a major motivator for young people to create online is to do so as part of a online or offline community.

'''Myth #7'''
''Digital Natives are all politically engaged on the internet.''

Most digital natives are not politically engaged, online or off. We did not meet many young people taking part in civic activities online. But the potentials for engagement are great in the digital space due to two major factors: (1) digital natives understand their active role in society, and that their voices are and will be heard (2) online spaces are extremely fluid – based on networks, a single space accommodates for entertainment, socializing, learning, and political engagement - in doing so, networks readily draw those young people who may otherwise be uninspired politically to begin to engage.

'''Myth #8'''
''Digital Natives behavior is outside the realm of understanding for parents, teachers, and other digital immigrants.''

Promises and perils online are often rooted in the same core issues and causes as their offline equivalents. Parents and teachers have much knowledge and wisdom to help guide young people as they move about digital space. However, the medium is different, and it is important for those in the Digital Natives’ lives to learn about the online spaces young people are living in, just as they do about the real-life spaces.

'''Myth 9'''
''Digital Natives are a homogeneous body''
Current initiatives on online child safety assume that digital natives are a homogeneous body - accordingly, we rely on benchmarks of 'competency' based on the 'ideal prudent child.' Recognizing that digital natives have significant implications for the way we educate, engage and empower young people. More importantly, we need to rethink whether the best interests principle or competency rhetoric continues to be relevant in the digital environment.

If so I wonder whether it might be interesting to have a discussion - either separate session or a component within the same session - perhaps in conjunction with Ethan given the work that he funds... which might be called something like "Why Free Speech Needs Free Culture," or something. It would explore the limitations of commercial for-profit businesses and services when it comes to ensuring that spaces continue to exist around the world where free expression and privacy are truly possible. Not that the corporate principles for privacy and free expression aren't a good idea, of course they are. But I'd like to push the conversation further: at the end of the day if space for free speech and privacy are going to survive amidst so many pressures by governments on companies, do we need to make sure that there are plenty spaces for expression and communication around the world that are NOT commercial? Put another way, to what extent will the survival of free speech and privacy depend on the cultivation of vibrant non-commercial, grassroots spaces?

I gave an example of the problem during a talk I gave in Taipei in January: in China, people are increasingly finding that Web2.0 tools - blogs etc., have limited use when it comes to promoting provocative political ideas because Chinese Web2.0 services are cenored. So as Michael Anti pointed out in his talk to the Berkman Ctr last fall, people in China are turning back to 1.0 tools: e-mail and e-mail groups as the best way to disseminate provocative ideas. But there's a problem. Now that nobody trusts Yahoo for good reason and they can't trust Chinese e-mail providers and Hotmail isn't secure, everybody uses Gmail. But what if the Chinese government decides to block Gmail - if not permanently then at least during sensitive political times (like the June 4th anniversary or the Olympics)? Then there are no alternatives except PGP which nobody uses because it's too technically complicated for most people and also draws attention to its users. If Chinese activists wait around for other commercial alternatives to emerge, will they be waiting for a blue moon? Or do grassroots groups, NGO's and loose alliances of people need to get more proactive in creating alternatives for secure e-mail and low-tech electronic communications? Are we sometimes overly obsessed with Web2.0 that we forget how important it is to have solid and secure alternatives for the simplest forms of internet communication? Given what's going on in Congress and in Europe lately, maybe we need to be more concerned about these issues for U.S. and other Western users as well?
* '''Suggestion:
* can't we reserve second tables for the dinners which seem with huge waiting lists - e.g. the Gene Koo, and the David Weinberger ones?''' [[User:Veni Markovski|Veni Markovski]] 12:59, 15 May 2008 (EDT)
** Yes, I just did :-) Power to the blogger -- PHB
** We've found over the years that these discussions work best when the group is small enough for everyone to easily talk to each other. But there's nothing stopping more dinners from being planned! Anyone can spearhead a new dinner. Talk to a Berkman staffer about finding a local restaurant and getting a table reserved.
*** We can have two groups of 8 having 2 discussions on the same topic in the same restaurant, though. I'm considering doing that with media, which is almost full before even being on the wiki.
* Thanks, guys. See you at the second table :) [[User:Veni Markovski|Veni Markovski]] 14:41, 15 May 2008 (EDT)
* Perhaps we can do the Oxford desert thing and re-org tables at the desert course.

Twitter has become a popular tool at conferences, because its quick & easy "microblogging" format makes it simple for folks at the same event to update each other and take notes on their impressions. It can be useful for jotting down a quote you hear and want to remember, letting your friends know what session you're in, or asking for local information. Aggregated together, the "tweets" about a conference can help form a richer picture of the event and its many conversations.
* Use the hashtag #berkman to tag your tweets about Berkman@10 (put #berkman into your tweet, and follow [http://twitter.com/hashtags @hashtags] on Twitter). We'll use tags to help find photos, blog posts and more created by conference attendees. We're aggregating all these tags into one big one-stop superfeed.

'''The universal tag is "Berkmanat10"''' If you like, you may also use "Berkman" (e.g. on Twitter, where character space is limited)

===Question Tool===

The Question Tool is used to ask questions during an event. Everyone can vote individual questions up or down and comment on existing questions, helping enhance the dialogue and letting moderators know which questions are most interesting to attendees.

* Pose questions here: http://cyber.law.harvard.edu/questions/berkmanat10

===IRC Channel===

IRC stands for Internet Relay Chat. For Berkman@10, we'll be using IRC to create a Berkman chat channel. To join the chat, download an IRC client and join the Berkman channel at Freenode, linked below. If you use Firefox, an easy IRC client plugin is [https://addons.mozilla.org/en-US/firefox/addon/16 Chatzilla].
===Facebook Group===

The Facebook social network is open to anyone. If you're on Facebook, you can meet other conference attendees on our group event page.

* Coming to the conference? [http://www.facebook.com/event.php?eid=12301401907 Join our Facebook Group!]
===Flickr===

Flickr is a photo sharing website where you can upload conference pictures. Be sure to tag them Berkmanat10 so they show up to folks looking for conference pics. You can set your default tags for new uploaded pictures so you won't forget.

* [http://www.flickr.com/photos/tags/berkmanat10/ Berkmanat10 Flickr tagged photos]

===Twitter===

See the feed of everyone's hashtagged tweets at http://hashtags.org/tag/berkman. You can also see mentions of Berkman at http://twemes.com/berkman. ''Hashtags.org seems to be down - rely on Twemes instead''

Best is to use [http://backchannel.us?bc=berkman www.Backchannel.Us?bc=berkman] for live tweet results on the topic Berkman

* Get official updates by following [http://twitter.com/BerkmanCenter @BerkmanCenter].

* Check @BerkmanCenter's following list to find Berkman affiliates and other conference attendees.

* Need info on how to use Twitter? Check out the [http://twitter.pbwiki.com/ Twitter Fan Wiki]

===Second Life===

The Berkman Center has an island in the virtual world Second Life. We'll be streaming the video webcast of the conference to the meeting space on the island. If you're participating remotely, chatting with other remote attendees' avatars in Second Life might just be the next best thing to being here in person.

Didn't bring a laptop but want to participate in the social tools fun anyway? We've also got a Wiffiti screen set up. You can send short messages to the Berkman@10 Wiffiti screen by using your mobile phone to send a text message to 25622 that starts with the phrase @Berk10. The screen is available online, and will be projected live during our reception on Thursday evening.

Our notions of privacy have been formed when space was the defining feature. The permanence of most online material brings in a big temporal component. Things shift over time—the words I add to a profile get repurposed when the company that owned that site is bought. How do we communicate the degree of public or private a particular context is? What do we know of the eye that is watching—what should we know of its intent and capabilities? How do we balance the desire for “public security” with our rights of privacy and anonymity? Is this a false dichotomy? What principles, practices and technologies should be employed towards protecting and advancing these rights in the digital future?
New media forms have dramatically changed the way news and information are gathered, packaged and disseminated. Anyone with Internet access can get and comment on political reporting and commentary from myriad perspectives, report on her/his own experiences, connect with fellow members of nearly any group imaginable, find out more than seems possible to know about the technical tools and toys that we love and hate and watch video of violence and natural disasters across the world as easily as those from down the street. What's missing? What issues, places, communities are not being reached or represented? What dynamics affect what is able to be meaningfully heard in the overcrowded information space? What are most promising models to expand the power of the network into new areas: news and information that cross traditional borders, require long-term collaborative efforts, or involve populations who have not joined the online world for whatever reason?

Network neutrality (also net neutrality, Internet neutrality) is a principle proposed for user access networks participating in the Internet that advocates no restrictions on content, sites, or platforms, on the kinds of equipment that may be attached, and on the modes of communication allowed, as well as communication that is not unreasonably degraded by other traffic.

The principle states that if a given user pays for a certain level of Internet access, and another user pays for a given level of access, that the two users should be able to connect to each other at the subscribed level of access.

Though the term did not enter popular use until several years later, since the early 2000s advocates of net neutrality and associated rules have raised concerns about the ability of broadband providers to use their last mile infrastructure to block Internet applications and content (e.g. websites, services, protocols), particularly those of competitors. In the US particularly, but elsewhere as well, the possibility of regulations designed to mandate the neutrality of the Internet has been subject to fierce debate.

'''Introduction'''
The impact of the Internet on democracy and politics is one area of inquiry which is still largely unsettled, constantly evolving, and in need of thoughtful and skeptical analysis. During the Internet and Politics session of the Berkman@10 conference, John Palfrey will lead the group—drawing heavily on the expertise of conference participants—through three themes that draw out some of the most important arguments, best examples, and debatable hypotheses about the lasting impact of the Internet on free speech, individual autonomy, and organization.

== Argument 1 ==
The Internet allows more free speech from more people than ever before, but states are finding ways to filter and limit that speech.

'''Hypotheses:'''
* According to the theory of the networked public sphere, the old media model has been inverted thanks to the Internet. Instead of the old hub and spoke information and communications architecture of the past, the Internet’s peer-to-peer architecture allows us to hear more voices, from more places, and about more issues than ever before.
* This new information architecture also means that costs are high for regimes that want to try to control Internet speech; it is no longer as simple as shutting down a TV or radio station.
* Free speech online is more valuable, and the need for regimes to control it more critical.

== Argument 2 ==
There is greater autonomy of the individual because of the Internet.

'''Hypotheses:'''
* The Internet and the emergence of the networked public sphere have the potential to increase individual autonomy. It increases the range and diversity of things that individuals can do for and by themselves and places the tools necessary for effective action in the hands of individuals, instead of corporations or government. Further, we are no longer passive consumers of information—we are active producers and propagators of ideas, culture, news, and policy.
* Questions around how a society produces information and allow access to it go to the heart of the meaning of freedom. Those questions determine what is understood to be open for debate, what possible goals for collective action are, and what the paths for that action are.
* The theory of semiotic democracy is also instructive: We no longer rely on institutions or corporations to create culture and meaning for us. Instead, the Internet allows us to create, manipulate, mash up and make our own meaning from cultural and political icons and images. This means we are less reliant on political parties, corporations, or political consultants to tell us what we think of a political candidate or policy issue; we can now decide for ourselves and share it virally.

== Argument 3 ==
The Internet enables new types of groups to form around interests and causes. The formation of online groups will alter the form and function of existing organizations and institutions with unknown impacts on democracy and governance.

'''Hypotheses:'''
* The networked public sphere increases the ability of individuals to form loose groups with more individuals and to be part of more causes than ever before. We now have the freedom and tools to collaborate more effectively with others.
* Online collaboration is lighter, more issue specific, and more time-bound than the previous generation of offline organizations.
* It is not clear how online groups will influence existing organizations and whether they will strengthen and complement, weaken, or replace them
* Money may become less important to a cause’s success with light collaboration by a large number of individuals with a common purpose and clear vision of ‘success.’

== Comments? Responses? Countervailing Theories? ==

* Patrick Meier, [http://irevolution.wordpress.com/bio/ PhD Candidate & iRevolution]. I am writing a [http://irevolution.wordpress.com/dissertation/ dissertation] on this topic.

Is this open to just attendees at the conference?

doesn't look that way...

* Vicki Nash, [http://www.oii.ox.ac.uk/ OII]
This was a great session, beautifully chaired by John to highlight the range of thinking on some of these issues. The two related questions that are engaging us in Oxford at the moment are:

1. (Re. hypothesis 1) The Internet does seem to enable more people to have a voice but does this mean that more voices are actually being heard?

Here, we're interested in testing the hypotheses posed by Cass Sunstein - that when faced with the immense variety of news and information sources online we just stick to the familiar 'Daily me' - and [http://www.matthewhindman.com/ Matthew Hindman's] concept of 'Googlearchy' - that whilst we need search engines to play a gate-keeping role online, their search algorithms favour large, well-resourced established information providers rather than Joe Bloggs' blog.

2. (Re. hypothesis 2) The Internet does seem to offer people the promise of more political autonomy, but is this only the result of participation in political practice or information-seeking?

Here we're wondering whether the potential for civic engagement might be enhanced not just by the development of new tools and new information sources, but by the fact that we increasingly get a little bit of politics with our entertainment and a little bit of entertainment with our politics. So we might wonder whether Youtube videos or Facebook groups engage those who would never sign up through a party website.

We don't have any results yet but hope to start a study on this soon.
